- -- --- --- <br />r MAR 111981 <br />TO: Honorable Members <br />Board of County Commissioners <br />FROM: Neil Nelson <br />County Administrator <br />DATE: March 6, 1981 <br />BonK 46 parf 44 <br />FILE: <br />SUBJECT: Amendment to C-1 Commercial District <br />REFERENCES: Planning & Zoning Commission <br />Meeting <br />This amendment proposal was initiated by the County Commission when Mr. Art Wilson <br />asked for a rezoning of the property of Mr. Dean Bruce from C -1A to M-1 for the <br />purpose of erecting mini -warehouses. This property is located on the north side <br />of Cemetery Road between U.S.#1 and Old Dixie Highway. <br />These gentlemen withdrew the application for the rezoning upon the suggestion of <br />the County Commissioners who agreed to initiate the proposal to amend the 'above <br />indicated section of the ordinance. This public hearing on rezoning was held in <br />September, 1980, and the public hearing on the proposed amendment was held on <br />December 17, 1980, at which time the issue was referred to the Planning and Zoning <br />Commission for consideration. <br />The final discussion on this matter was held by the Planning and Zoning Commission <br />on Thursday, March 5, 1981, and they recommended against adoption of the proposed <br />amendment by a 3 - 1 vote. <br />Tony Soviero, County Attorney, suggested that the provision of the proposed amend- <br />ment would allow mini -warehouses as a special exception. The special exception <br />provision would allow the Planning and Zoning Commission considerable discretion <br />in the determination of the compatibility of use on a site by site basis. <br />The Planning staff suggested that the C -1A Commercial District allows some more <br />intensive uses than the LM-1,Light Manufacturing District. The C -1A District <br />does not specify intended purpose of the district, but contains only special <br />exceptions. The LM -1 District, however, states the purpose of the district as: <br />Purpose of district: The LM -1, Light Manufacturing District, is <br />intended to provide a restricted Light Industrial -District for <br />enclosed storage, research, development, and manufacture of small <br />products making the use of processes of manufacturing not likely <br />to be objectionable to neighboring properties because of noise, <br />vibration, odors, smoke, air pollution or other physical mani- <br />festations. The development standards in LM -1 Districts are in- <br />tended to assure an open, uncrowded and attractive appearance <br />through limitations on yards, setbacks, coverage and location of <br />incidental activities. The LM -1 District uses shall bd located <br />with convenient access to transportation facilities. (Ord. No. <br />74-27, 1-15-75) <br />The M-1, Industrial District allows storage under the following provision: <br />(A) Uses permitted. In this district a building or premises may <br />be used only for the following purposes: <br />1) Retail, wholesale, rental, distribution, auction and/or <br />storage of new or used goods. <br />Based on these considerations, it is felt mini -warehouses are most appropriately <br />located in the LM -1 and M-1 Districts. <br />
