_ n <br />MAR 16 1981 BOOK- F� <br />CHAIRMAN LYONS ANNOUNCED THAT THIS ACTUALLY IS A FACT- <br />FINDING MEETING IN RESPONSE TO .JUDGE SHARPS ORDER TO SHUT THE <br />UTILITY DOWN, TO HEAR PRESENTATIONS AS TO THE EXISTING CONDITIONS <br />OF THE FACILITY, TO GAIN THE PUBLIC INPUT, AND TO HEAR FROM THE DER <br />AND FROM TREASURE COAST UTILITY.- HE STATED THAT WE DO NOT EXPECT <br />TO REACH ANY DECISION TONIGHT. <br />ATTORNEY COLLINS THEN GAVE A HISTORY OF THE FRANCHISE, <br />WHICH ORIGINALLY WAS GRANTED TO SOUTHERN GULF UTILITIES, INC., IN <br />1960. HE SPOKE OF THE CONSIDERABLE REDUCTION OF THE FRANCHISE AREA - <br />IN 19731 THE CONTINUING HISTORY OF POOR SERVICE, THE TRANSFER OF THE <br />FRANCHISE IN 1976 To TREASURE COAST UTILITIES, INC., AND THEIR <br />ACCEPTANCE OF THE FRANCHISE SPECIFICALLY INCLUDING RESOLUTION 76-32 <br />IN REGARD TO INCORPORATING THE LINES IN THE FUTURE IN THE COUNTY <br />SYSTEM. MR. SALTER, THE PRESENT OWNER, PURCHASED THE STOCK OF <br />TREASURE COAST UTILITIES FROM MR. LOHMAN IN 1976 SUBSEQUENT TO THEIR <br />ACCEPTANCE OF THE FRANCHISE AND RESOLUTION 76-32. ATTORNEY COLLINS <br />THEN LISTED THE LEGAL ACTION TAKEN, BEGINNING WITH THE FILING OF A <br />COMPLAINT AGAINST TREASURE COAST UTILITIES IN MAY OF 1976 BY THE DER <br />FOR FAILURE TO COMPLY WITH THEIR REGULATIONS. THE SUIT CONTINUED <br />UNRESOLVED THROUGH 1977 AND IN SEPTEMBER OF 1978 A SUPPLEMENTAL <br />COMPLAINT WAS FILED BY THE DER. THIS COMPLAINT WAS NOT ANSWERED, A <br />DEFAULT WAS ENTERED IN DECEMBER OF 1978, AND ON APRIL 8, 1980, JUDGE <br />SHARP ENTERED AN ORDER ENJOINING THE COMPANY FROM OPERATION AND <br />REQUIRING THAT A $75,000 BOND BE POSTED WITH THE PROVISION.THAT THE <br />BOND FUNDS WERE TO BE USED FOR CONSTRUCTION OF SEWER FACILITIES TO <br />SERVICE THE AREA. THE BOND WAS NOT RAISED NOR THE ORDER COMPLIED <br />WITH; AN ORDER OF CONTEMPT OF COURT WAS ENTERED BY JUDGE SHARP ON <br />FEBRUARY 20, 1981; AND TREASURE COAST UTILITIES NOW HAS FILED A <br />MOTION FOR REHEARING AND RELIEF FROM THE FINAL JUDGMENT. <br />CHAIRMAN LYONS ANNOUNCED THAT ALL WITNESSES WILL BE SWORN <br />IN AND QUESTIONED UNDER OATH. <br />DEPUTY CLERK HARGREAVES SWORE IN COUNTY CONSULTING ENGINEER, <br />JOHN ROBBINS,WITH THE FIRM OF SVERDRUP & PARCEL. <br />MAR j"81 � . � <br />
