ASSISTANT COUNTY ATTORNEY HOULIHAN STATED THIS ORDINANCE <br />WAS JUST A MATTER OF FORM. <br />THE CHAIRMAN ASKED IF THERE WAS ANYONE PRESENT WHO WISHED TO <br />BE HEARD. THERE WERE NONE. <br />ON MOTION MADE BY COMMISSIONER WODTKE, SECONDED BY COMMIS- <br />SIONER SCURLOCK, THE BOARD UNANIMOUSLY CLOSED THE PUBLIC HEARING. <br />MOTION WAS MADE BY COMMISSIONER SCURLOCK, SECONDED BY COMMIS- <br />SIONER BIRD, FOR THE BOARD TO ADOPT ORDINANCE 51-23 DECLARING THE <br />INTENT OF THE BOARD TO EXERCISE THE AUTHORITY GRANTED -TO IT UNDER.THE <br />LOCAL GOVERNMENT COMPREHENSIVE PLANNING ACT OF 1975. <br />ATTORNEY HOULIHAN EXPLAINED THAT THE BOARD IS MERELY STATING <br />THAT THEY ARE EXERCISING THE AUTHORITY GRANTED TO THE COUNTY; THIS HAS <br />NO EFFECT ON ANY EXISTING ORDINANCE. <br />SOME DISCUSSION FOLLOWED. <br />THE CHAIRMAN CALLED FOR THE QUESTION. IT WAS VOTED ON AND <br />CARRIED UNANIMOUSLY. <br />ORDINANCE NO. 81- 23 <br />AN ORDINANCE DECLARING THE INTENT OF THE BOARD <br />OF COUNTY COMMISSIONERS OF INDIAN RIVER COUNTY, <br />FLORIDA, TO EXERCISE.THE AUTHORITY GRANTED TO <br />IT UNDER THE LOCAL GOVERNMENT COMPREHENSIVE <br />PLANNING ACT OF 1975, SECTIONS 163.3161 - <br />163.3211, FLORIDA STATUTES, AND FOR PROVIDING <br />AN EFFECTIVE DATE. <br />BE IT ORDAINED BY THE BOARD OF COUNTY CQMMISSIONERS OF <br />INDIAN RIVER COUNTY, FLORIDA, <br />In compliance with Section 163.3171(.2), Florida Statutes, <br />the Board of County Commissioners of Indian River County, Florida <br />hereby declares its intent to exercise, in the unincorporated <br />areas of Indian River County, Florida, the authority set out <br />in Sections 163.3161 - 163.3211, Florida Statutes, commonly <br />known as "The Local Government Comprehensive Planning Act of <br />1975". <br />This Ordinance shall take effect July 6, 1581. <br />11 <br />J U L 1 1981 <br />MGK U Fr�GC WI 43 <br />
