C . State <br />Statutes <br />a. Chapter 252 - State Emergency Management Act. Chapter <br />252.38, Florida Statutes, delineates the emergency <br />management responsibilities of political subdivisions in <br />safeguarding the life and property of citizens and other <br />persons within the political subdivision. Key points within the <br />statutes include: <br />(1) Performing emergency management functions within <br />the territorial limits of Indian River County and conduct <br />those activities pursuant to 252.31--252.90, and in <br />accordance with state and county emergency <br />management plans and mutual aid agreements. <br />(2) Appointment of a Director who meets the minimum <br />training and education qualifications established in the <br />job description approved by the Board. The Director will <br />be appointed to serve at the pleasure of the Board, <br />subject to the Board's direction and control, in <br />conformance with applicable resolutions, ordinances <br />and laws. The Director has responsibility for the <br />organizations, administration and operation of Indian <br />River County Emergency Management division, subject <br />only to the direction and control of the Board of County <br />Commissioners and the County Administrator. The <br />Director will coordinate emergency management <br />activities, services and programs within the County and <br />will serve as liaison to the Florida Division of Emergency <br />Management and other local emergency management <br />organizations. <br />(3) Establishment, as necessary, a primary and one or <br />more secondary emergency operating centers (EOCs) <br />to provide continuity of government and direction and <br />control of emergency operations. <br />(4) Power to appropriate and expend funds; make <br />contracts; obtain and distribute equipment, materials <br />and supplies for emergency management purposes; <br />provide for the health and safety of persons and <br />property, including assistance to victims of any <br />emergency; and direct and coordinate the development <br />of emergency management plans and programs in <br />Indian River County Comprehensive Emergency Management Plan Basic Page 119 <br />
