IT WAS VOTED ON AND <br />CARRIED UNANIMOUSLY. <br />RESOLUTION 81-1a5 ADOPTING RATE INCREASE FOR HOBART LANDING <br />LOTION WAS MADE BY COMMISSIONER WODTKE, SECONDED BY <br />COMMISSIONER BIRD, TO ADOPT RESOLUTION 81—L15 GRANTING A RATE INCREASE <br />FOR HOBART LANDING AS APPROVED AT THE MEETING OF .JULY 1, 1981, <br />COMMISSIONER SCURLOCK STATED THAT HE HAD UNDERSTOOD THAT <br />THE FINANCE OFFICER WAS GOING TO COME UP WITH SOME KIND OF SPECIFI': <br />FORMULA TO GIVE THE COUNTY A MEANS OF EVALUATING AND ADJUSTING THE <br />MONEY THAT SHOULD BE ESCROWED AND TO INCREASE IT�IF NECESSARY, <br />BECAUSE IF IT TURNED OUT THAT A PLANT WAS NOT MAINTAINED PROPERLY <br />DURING THE YEAR, AN AMOUNT SUCH AS $8,000 COULD END UP BEING <br />INSIGNIFICANT. HE DID NOT FEEL THERE IS A BIG PROBLEM WITH THIS <br />PARTICULAR FRANCHISE BUT THAT WE DO NEED TO GET SOME CONTROL OF THIS <br />PROBLEM IN GENERAL. <br />THE BOARD GENERALLY AGREED THAT THIS SYSTEM WAS NOT OF A <br />MAGNITUDE TO BE A SIGNIFICANT PROBLEM, BUT IT WAS ALSO NOTED THAT <br />IF THE $8,000 WERE TO BE DEPLETED, THERE WOULD BE NOTHING TO <br />FALL BACK ON. <br />ATTORNEY COLLINS FELT WE COULD CLARIFY THE RESOLUTION AND <br />PUT THE BURDEN ON THE FRANCHISEE FOR MAINTENANCE. <br />COMMISSIONER BIRD SUGGESTED THAT WE CONSIDER REWORDING <br />THE PHRASE "IN THE EVENT THE FRANCHISEE FAILS TO MAKE NECESSARY <br />REPAIRS OR REPLACEMENT AS WOULD BE'REQUIRED BY INDUSTRY PRACTICE <br />OR CUSTOM" TO READ THAT IT WOULD BE "AS REQUIRED BY ANNUAL INSPECTION". <br />THE BOARD AGREED THIS WAS A GOOD THOUGHT, <br />ATTORNEY COLLINS RECOMMENDED THAT A PHRASE BE ADDED IN <br />RESOLUTION 81-45, PARAGRAPH 2, AFTER THE WORD AVAILABLE, TO READ AS <br />FOLLOWS: "2. HOBART LANDING SERVICES COMPANY AGREES TO IMMEDIATELY <br />MAKE AVAILABLE, MAINTAIN AND REPLENISH IF DIMINISHED, THE SUM OF <br />$8,000 TO BE PLACED IN AN INTEREST BEARING ACCOUNT BY THE COUNTY." <br />P00K 46PAGE 8 11 <br />JUL 151981 49 <br />
