AUG ���� E�OQ�( r FACE 132 <br />per day, the said 100,000 gallons of water and sewer represents <br />the total gallons per day available from the combined Vista <br />Royale and Vista Royale Gardens facilities. VISTA retains the <br />use of all capacities in excess of the aforesaid minimums for <br />its use in its various projects including present and future <br />developments which may be serviced by such facilities. The <br />aforesaid 100,000 gallon capacities for water and sewer are <br />based upon the proposed maximum expansion of Vista Royale and <br />Vista Royale Gardens and expec`ad uses, as attached hereto as <br />Exhibit B-8. Provided further that if VISTA does not exceed <br />the stated maximum expansion, VISTA shall not be responsible <br />for failure of the system to provide the said guaranteed <br />capacities after the COUNTY assumes management and operational <br />control of the water and sewer treatment facilities. <br />B. VISTA assumes no responsibility nor any; <br />liability for the capacities of any potable well. <br />C. VISTA represents to COUNTY the COUNTY will <br />be permitted to hook up into the VISTA water system after <br />March 31, 1981 and further represents that said hook-up will <br />provide 100,000 gallons per day from the Vista Royale water <br />treatment plant. <br />D. VISTA further agrees that the COUNTY may, <br />after March 31, 1981, utilize all water and sewage capacities <br />mentioned in this Agreement as the COUNTY may, from time to <br />time, determine, provided, however, the precise location of the <br />hook-up shall be determined by VISTA. <br />E. For those residential and commercial units <br />located in Vista Royale or Vista Royale Gardens or Forest Park <br />Subdivision areas connected to this utility system, the parties <br />agree that VISTA has prepaid all impact fees charged and <br />chargeable by its contribution of the assets of the water and <br />sewer systems of Vista Royale and Vista Royale Gardens. <br />F. VISTA will continue to install water and <br />sewer lines, fire hydrants, and water meters according to the <br />COUNTY'S specifications and other applicable government laws <br />7 <br />
