ORDI NA.:.... .,O. 7II-14 <br />AN ORDINANCE ADOPTING A FIRE PREVENTION CODE PRESCRIBING <br />REGULATIONS GOVERNING CONDITIONS HAZARDOUS TO LIFE AND <br />PROPERTY FROM FIRE OR EXPLOSION, PROVIDING, FOR ADMINIS- <br />TRATION, PENALTIES AND AN EFFECTIVE DATE. <br />BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF <br />INDIAN RIVER COUNTY, FLORIDA: <br />ARTICLE IX <br />Section 4-110. ADOPTION OF FIRE PREVENTION CODE. <br />There is hereby adopted by the County of Indian River, <br />Florida, for the purpose of prescribing regulations governing <br />conditions hazardous to life and property from fire or explo- <br />sion, that certain code known as the Fire Prevention Code <br />recommended by the American Insurance Association, being <br />particularly the 1976 Edition thereof; and the whole thereof, <br />save and except, such portions as are hereinafter deleted, <br />modified, or amended, of which Code not less than three (3) <br />copies shall be filed in the Office of the Clerk of the Circuit <br />Court and the same are hereby adopted as fully as it is set out <br />at length herein; and the provisions thereof shall be con- <br />trolling within the unincorporated limits of the County of <br />Indian River. <br />Section 4-111. ENFORCEMENT OF CODE. <br />a) The Fire Prevention Code shall be enforced by the <br />County Administrator, who shall have authority to <br />delegate his inspection and enforcement responsi- <br />bilties to such Fire Departments within the County, <br />as is necessary to enforce this Ordinance. <br />b) The County Administrator shall have control and <br />supervision of all fire prevention activities within <br />the unincorporated limits of the County of Indian River. <br />c) Whenever any dangerous or hazardous conditions or <br />materials are found, the County Administrator, through <br />his delegated enforcement official, shall order such <br />dangerous conditions or materials to be removed or <br />remedied in such a manner as may be specified by the <br />County Administrator. <br />Section 4-112. MODIFICATION. <br />The County Administrator shall have the power to modify any <br />of the provisions of the Fire Prevention Code upon application, <br />in writing, by the owner or leasee, or his duly authorized agent, <br />when there are practical difficulties in the way of carrying <br />out the strict letter of the Code, provided that the intent of <br />the Code shall be observed, public safety secured, and sub- <br />stantial justice done. The particulars of such modifications, <br />when granted or allowed, and the decision of the County <br />Administrator, or his delegated enforcement official, shall <br />be entered upon records of the County and a signed copy shall <br />be furnished the applicant. <br />Section 4-113. APPEALS. <br />Whenever it is claimed that the provisions of the Code do not <br />apply or that the true intent and meaning of the Code have been <br />misconstrued or wrongly interpreted, the person affected, or <br />his duly authorized agent, is permitted to appeal from the <br />decision of the County Administrator to the County Board of <br />1// <br />
