Fr - <br />SEP 2 1981 <br />2. Notify the ten customers by letter that they will be required to <br />reconnect to the water system, pay the impact - fee charged to everyone - <br />as well as the sewer service fees since the county has operated the <br />system. <br />3. The customer will have the opportunity to go to the utility office <br />and get the extended payment contract established for impact fees. <br />4. If the customer does not respond, the sewer service lateral will be <br />dug upind plugged - with additional service charged to cover the expense <br />of this added work then added to the outstanding bill. <br />RECOMMENDATION & FUNDING <br />We recommend that the Board of Commissioners approve the deletion <br />of $1,598.28 to be written off to "bad debt" and endorse the procedure <br />as outlined herein. <br />IN DISCUSSION, IT WAS NOTED THAT THE TIME PAYMENT PLAN WOULD <br />ALLOW THE CUSTOMER UP TO TWO YEARS TO PAY THE IMPACT FEES, COMMIS- <br />SIONER-SCURLOCK REPORTED THAT THE GIFFORD ADVISORY COMMITTEE IS VERY <br />MUCH IN FAVOR OF THE ADMINISTRATORS RECOMMENDATIONS, <br />COMMISSIONER FLETCHER INQUIRED AS TO ANY LEGAL RECOURSE <br />THESE INDIVIDUALS MIGHT HAVE IF WE HAVE TO TERMINATE THEIR SEWER <br />SERVICE, AND ATTORNEY COLLINS EXPLAINED THAT THEY WOULD NOT BE TERMI- <br />NATED WITHOUT PLENTY OF NOTICE, AND HE BELIEVED THE ONLY RECOURSE <br />THEY WOULD HAVE WOULD BE TO MOVE OUT BECAUSE HE DOUBTED YOU WOULD BE <br />ALLOWED TO INSTALL A SEPTIC TANK IF YOU HAVE A SEWER LINE RUNNING BY <br />YOUR HOUSE, <br />ON MOTION BY COMMISSIONER SCURLOCK, SECONDED BY COMMISSIONER <br />BIRD, THE BOARD UNANIMOUSLY APPROVED THE RECOMMENDATIONS OF THE ADMINIS- <br />TRATOR RE GIFFORD SEWER ONLY CUSTOMERS AS SET OUT IN HIS MEMO OF <br />AUGUST 26, 1981, <br />REFUND OF TAX DEED PROCEEDS TO LOLA SNOW AND CREATION OF POLICY <br />ATTORNEY COLLINS EXPLAINED THE PROCEDURES SET UP BY THE <br />STATUTES RE PROCEEDS FROM TAX SALES WHEREBY THE PROPERTY OWNER IS <br />NOTIFIED AND CAN CLAIM THE FUNDS FROM THE CLERK WITHIN 90 DAYS AFTER <br />THE SALE, IF THESE FUNDS ARE UNCLAIMED AFTER THE 90 DAYS, THEY GO <br />INTO THE GENERAL FUND, AND THE PROPERTY OWNER IS ALLOWED TWO YEARS <br />TO MAKE A CLAIM TO THE BOARD OF COUNTY COMMISSIONERS FOR A REFUND. <br />THE ATTORNEY SUGGESTED THAT THE BOARD ESTABLISH A POLICY AUTHORIZING <br />THE FINANCE OFFICER TO PAY THESE FUNDS TO THOSE MAKING PROPER CLAIMS <br />WITHIN THE TWO YEAR PERIOD, <br />
