777 - <br />INDIAN RIVER COUNTY ORDINANCE NO. 77- 32 <br />AN ORDINANCE CREATING THE INDIAN RIVER COUNTY PARK <br />AND RECREATION DEPARTMENT; AUTHORIZING SAID DEPART- <br />MENT TO ESTABLISH PROCEDURES, RULES AND REGULATIONS <br />FOR THE OPERATION OF PARKS WITHIN INDIAN RIVER COUNTY, <br />FLORIDA; AUTITORIZING TITE APPOINTMENT BY THE DEPARTMENT <br />HEAD OF LITTER ENFORCEMENT OFFICERS; MAKING VIOLATIONS <br />OF THIS ORDINANCE A MISDEMEANOR AND ESTABLISIIING AN <br />EFFECTIVE DATE. <br />BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF <br />. INDIAN RIVER COUNTY, FLORIDA: <br />Section 1. This Ordinance shall be known and cited as the Indian River <br />County Parks and Recreation Department Ordinance. <br />Section 2. The regulation of County owned or controlled Parks and <br />Recreation areas in Indian River County is declared to be in the public <br />interest and this Ordinance is an exercise of the police power of the County <br />for the protection of the public health, safety and welfare. Provisions of <br />this Ordinance shall be liberally construed for the accomplishment of this <br />purpose. <br />Section 3. There is hereby created in Indian River County, Florida, a <br />department known as the Indian River County Parks and Recreation Department. <br />The Department shall be headed by the Indian River County Administrator. <br />Section 4. The Indian River County Parks and Recreation Department <br />shall establish standards, rules and procedures for the use and operation of <br />Parks and Recreational areas under the jurisdiction of Indian River County <br />Commission in the unincorporated or incorporated portion of Indian River <br />County, Florida. <br />Section 5. The County Administrator shall appoint pursuant to Florida <br />Statute 403.413 (1975) an Indian River County Litter Officer or officers who <br />shall be employees of the Indian River County Parks and Recreation Depart- <br />ment. Said employees shall qualify as law enforcement officers for the <br />purposes of enforcing Florida Statute 403.413 (1975) and this Ordinance. <br />
