LEASE AGREEIIENT <br />THIS LEASE, entered into this 30th day of September , <br />1981, by and between the Board of Commissioners, Indian River <br />County, Florida, hereinafter referred to as "Lessor" and the City <br />of Fellsmere, a municipal corporation of the State of Florida, <br />hereinafter referred to as "lessee". <br />WHEREAS, Lessor desires to enter into a lease with Lessee <br />for the consideration of One Dollar per year and in consideration <br />of the covenants contained herein pursuant to authorization for <br />execution of said lease as established by motion September 30, <br />1981; and <br />WHEREAS, Lessee desires to lease from Lessor the herein- <br />after described property for the sum of One Dollar per year and in <br />consideration of the covenants hereinafter set forth, pursuant to <br />authoriztion for exectuion of said lease as established by City <br />of Fellsmere Resolution No. 81-D. <br />IT IS THEREFORE, in consideration of the premises and <br />the covenants hereinafter set forth the parties mutually agreed as <br />follows: <br />1. For the sum of One Dollar per year the Lessor does <br />hereby lease to Lessee for a period of twenty (20) years the follow- <br />ing described real property. <br />Lots 1 & 2, Block 96 according to the plat of <br />the Town of Fellsmere, which said Plat was filed <br />in the office of the Clerk of the Circuit Court <br />of Saint Lucie County, Florida, in Plat Book 2, <br />Pages 3 and 4; said land lying and being in Indian <br />River County, Florida. <br />2. The Lessee is restricted in its use of the property <br />as follows: <br />(a) The purpose of the lease is to permit Lessee to <br />construct, operate and maintain a sports field for various age <br />categories of children and to coordinate the use of the field for <br />sports practices and regularly scheduled games. <br />(b) At all times when the property subject to this leas: <br />is not being so utilized pursuant to the provisions of Paragraph <br />(a), it shall be open to the public. <br />SEP 30191 <br />BOOK <br />
