P <br />OCT 211981 BOOK 4 7 FA;E <br />bring that up at this time because he felt it would open up a <br />prolonged discussion, and we are not at substantial <br />completion and are not occupying the building. He further <br />noted that we have never agreed to a $400 charge per day <br />rather than $300 for the additional required days. <br />Commissioner Scurlock commented that he has heard for <br />the last eight months that we should not pay attention to the <br />matter of extra days now, but wait until the end, and this <br />causes him great concern. <br />Mr. Kontoulas noted that under the contract, we have the <br />right to retain liquidated damages, and right now we are <br />holding a retainage of $313,173. He believed the request <br />for additional days and the amount of retainage balance each <br />other, and did not feel this matter should be dealt with now. <br />Administrator Nelson commented that we acted in this <br />manner on the Courthouse, when -the contractor asked for 66' <br />days and we were only willing to give him 20, and we have not <br />heard any further on this. <br />Chairman Lyons stated that he was inclined to take the <br />advice of Mr. Kontoulas on this matter. <br />On Motion by Commissioner Bird, seconded by Commissioner <br />Wodtke, the Board unanimously approved Change Order 68 - <br />Administration Building in the amount of $3,046.24, with the <br />normal stipulation that by approving the change order the <br />County does not waive any rights it has to claim damages <br />against the contractor or the architect because of omissions <br />or other reasons that may arise. <br />On Motion by Commissioner Bird, seconded by Commissioner <br />Wodtke, the Board unanimously approved Change Order 69 - <br />Administration Building issuing a credit in the amount of <br />$178.95, with the normal stipulation that by approving the <br />change order the County does not waive any rights it has to <br />claim damages against the contractor or the architect because <br />of omissions or other reasons that may arise. <br />Iwo <br />
