BOOK -8 PAGE <br />4 - _ <br />and contractor. <br />17. The ENGINEER will prepare notices and advertisement of final payments if <br />required by state statutes. <br />18. The ENGINEER will be available to furnish engineering service and consul- <br />tations necessary to correct all unforeseen project operating difficulties <br />for a period of 1 year after the date of final inspection and acceptance <br />of the facility by the OWNER. This service will include instruction of <br />the OWNER in initial project operation and maintenance but will not include <br />supervision of normal operation of the system. Such consultation and advice <br />shall be furnished as an additional service and compensation shall be paid <br />to the ENGINEER in accordance with Section C of this Modification Number 6. <br />19. The ENGINEER further agrees to obtain and maintain, at the ENGINEER'S <br />expense, such insurance as will protect him and the OWNER from claims <br />under the Workman's Compensation Act and from all claims for bodily injury, <br />death, or property damage which may arise from the negligent performance <br />by the ENGINEER or by the ENGINEER'S employees of.the ENGINEER'S functions <br />and services required under this Modification Number 6. <br />20. The ENGINEER further agrees to prepare and submit all applicable permits as <br />Part of his basic compensation. Any additional work required by regulatory <br />agencies shall be as an additional service and the OWNER shall compensate <br />the ENGINEER in accordance with Section C, Additional Services, of this <br />Modification Number 6. <br />21. The OWNER intends to construct the South Beach Water System Improvements <br />in two phases. The ENGINEER will, therefore, prepare detailed construction <br />drawings, contract documents an'! provide resident inspection services for <br />each phase of construction. However, the design of both phases shall consti- <br />tute a master plan design of the South Beach Water System Improvements. <br />Compensation to the ENGINEER for basic services -for each phase of the design <br />and inspection shall be in accordance with Section B of this Modification <br />Number 6. The general scope of work for each phase is listed below and <br />includes but is not limited to the following: <br />Phase I: Design and Construction <br />Surveillance of: A. 750,000 gallon ground storage <br />tank. <br />Page Four <br />� � r <br />
