b. Applicant's Opportunity to Contest Designation; Mitigation. <br />Applicants for site plan review shall have an opportunity to <br />demonstrate that any areas which are designated as wetlands <br />within -the confines of their property no longer function as <br />wetlands. Areas identified as wetlands using the criteria <br />in "a" above, may receive a waiver from the Board of County <br />Commissioners regarding designation provided that the <br />applicant furnishes competent evidence indicating that a <br />majority of the following factors preclude the area(s) from <br />functioning as a viable wetland area: <br />i. inadequate size; <br />ii. isolation from similar or complementary habitats; <br />iii. proximity to adjacent urban land uses; <br />iv. disturbance or invasion of exotic species; <br />V. lack of species diversity; <br />vi. reduced frequency and length of inundation; and/or <br />vii. reduced salinity levels and tidal influence. <br />Any applicant who receives a waiver by the Board of County <br />Commissioners allowing the alteration of non-viable wetland <br />areas shall be required to provide viable wetland areas <br />through mitigation. Mitication may be accomplished by the <br />creation of entirely ne,� wetland areas, which should be <br />designed, constructed and raintained in a manner to mimic <br />natural areas. Mitigation u,ay also be accomplished through <br />the restoration of areas that were historically wetlands or <br />through the enhance -Fent of the functioning of existing areas <br />which may have been previously disturbed or which may have <br />the ability to provide additional or improved functions. <br />Density Limitations for Enyirorrentally Sensitive Land. <br />As established in the iridian River County Comprehensive <br />Plan, environmentally sensitive lands shall be limited to <br />the following maxir.,un gross density levels. <br />i. Environ-,entally Sensitive Lands East of i-95. Those <br />land areas deter -Fined to be environmentally sensitive <br />based on the criteria contained herein, which are <br />located east of I-95 shall be limited to a maximum <br />density of one (1) duelling unit per gross acre. <br />ii. Environmentally Sensitive Lands Test of I-95. -hose <br />land uses determined to be environmentally sensitive <br />based on the criteria contained herein, which are <br />located ;vest of I-95 shall be limited to a maximum <br />density of 0.20 duelling units per gross acre. <br />Density Transfers: Planned Residential Developments Only. <br />Section 25.4, "Planned Residential Development (PRD): <br />Special Exception Standards and Procedures", of the Zoning <br />Ordinance establishes a mechanism for transferring density <br />from environmentally sensitive lands to approved upland <br />areas. Density transfers shall be specifically limited to <br />projects receiving PRD special exception approval. <br />e. Additional Restrictions on Development Within Environmental- <br />ly Sensitive Areas. <br />In addition to the density limitations for environmentally <br />sensitive lands established in the Indian River County <br />Comprehensive Plan, as provided in paragraph "c" herein, all <br />environmentally sensitive lands shall be subject to the <br />following development restrictions: <br />i. Development shall be limited to upland areas; <br />ii. Where no upland area exists or where the upland is of <br />inadequate size to allow reasonable use of the land, <br />-25- <br />
