DEC 2 <br />im <br />AGREEMENT <br />Between <br />INDIAN RIVER COUNTY <br />and <br />TOWN OF INDIAN RIVER SHORES <br />THIS AGREEMENT, entered into the—j day of , <br />1981, by and between INDIAN RIVER COUNTY, a political subdivision <br />of the State of Florida, hereinafter referred to as "County", and <br />TOWN OF INDIAN RIVER SHORES, a municipal corporation created under <br />the laws of the State of Florida, hereinafter referred to as "Town", <br />heirs, successors and assigns: <br />WHEREAS, County and Town have been.involved in litigation over <br />the control and development of the park, which litigation is <br />referred to as Case No. 80-134; and <br />WHEREAS, the litigation, through appeals, determined that <br />certain areas, including the parklands described in Exhibit "A" <br />to this Agreement, were improperly annexed by the Town and the <br />annexing procedures were declared null and void; and <br />WHEREAS, the Town now desires to annex certain lands as shown <br />outlined in red on Exhibit "B" to this Agreement; and <br />: WHEREAS, the County lands which are to be used as a park are <br />part of Exhibit "B" shaded in blue to reflect that part of Parcel <br />1 lying West of Section 20.of Exhibit "A" and Parcel III and <br />shaded in green to reflect that part of ParcelI lying East of <br />Section 19, Parcel II and Parcel IV all of Exhibit "A"; and <br />WHEREAS, it is the intent of both County and Town to enter <br />into this Agreement to avoid additional litigation and to ac- <br />commodate the Town regarding proposed new annexation as reflected <br />in red on Exhibit "B"; and <br />NOW, THEREFORE, in consideration of mutual promises and other <br />valuable considerations, the parties agree as follows: <br />1. This Agreement is entered into pursuant to Chapter 163, <br />Part 1, Florida Statutes (1980) known as the Florida Interlocal <br />Cooperation Act of 1969. This Agreement during its term may not be <br />terminated or modified without the mutual consent of both parties. <br />
