URK PA <br />DEC 161991 <br />their architect and planner were present to briefly review <br />their proposed site plan. <br />Chairman Lyons noted that unless the Commission asked <br />for such a review, it is not necessary for the purpose of <br />rezoning; the question to be addressed is whether the <br />Commission will allow a density of 4 units per acre or not. <br />Commissioner Scurlock asked if Attorney Brandenburg has <br />had an opportunity to look at the dedication of restrictive <br />covenants submitted. <br />Attorney Brandenburg stated that the R -2A zoning <br />provides assurance that the property cannot be developed at <br />anything more than four units per acre, and in addition, the <br />owner has provided a dedication voluntarily stating that <br />they will not have anything more than four units per acre. <br />If the property was ever sold and an attempt was made to <br />develop at a higher density, that applicant would have to <br />come before the Board. Once the dedication is placed on the <br />property, it could be released by a future Commission, but <br />it would be an additional step a future owner would have to <br />take. <br />Chairman Lyons asked if the matter of getting the <br />• restrictive covenant is property tied in with rezoning, and <br />Attorney Brandenburg answered.that the Board cannot require <br />someone to enter into such a dedication, but in this case, <br />the applicant has volunteered; it is not a contract zoning <br />situation. <br />The Chairman asked if anyone present wished to be <br />heard. <br />Commissioner Fletcher wished to know if the home owners <br />on Orchid Isle were notified of the hearing, and Mr. Rogers <br />stated that he had met with the property owners of Orchid <br />Isle and they were aware of today's meeting. <br />Robert Reider spoke in behalf of the Vero Beach Civic <br />Association and read a resolution opposing any zoning being <br />granted to Marsh Island which would create future problems <br />50 <br />
