It was pointed out that Marsh <br />Island is,a spoil bank and does not have good percolation, <br />and therefore, believed that a package sewer plant would <br />malfunction; the availability of potable water also was <br />questioned. Mr. Reider felt the Commission should obtain <br />disclaimers as to sewer and water and further requested that <br />the same evaluation procedure be used in the future in <br />similar situations so a situation such as the Pebble Bay <br />problem would not reoccur. <br />Chairman Lyons wished to make the record clear as to <br />Pebble Bay Sewer Plant - it is not inoperative; it is a <br />plant that was improperly constructed and improperly <br />maintained, and the cost that is arising is to make it work <br />as it should have in the first place. <br />On Motion by Commissioner Bird, seconded by <br />Commissioner Wodtke, the Board unanimously closed the public <br />hearing. <br />Motion was made by Commissioner Bird, seconded by <br />Commissioner Scurlock, to adopt Ordinance 81-43 granting the <br />rezoning to R -2A as recommended by the Planning Department <br />and the Planning & Zoning Commission. <br />Commissioner Scurlock noted that his concern all along <br />was not to vote for anything over 4 units on this property. <br />He pointed out that concerns re waste water and ingress and <br />egress all have to be addressed at a later stage and assumed <br />that part of the Motion is an acceptance of the restrictive <br />covenants. <br />Attorney Brandenburg suggested that the representatives <br />of the project voluntarily indicate on the record that they <br />are offering the declaration of restriction freely and will <br />have it executed in a form acceptable to the Attorney's <br />office within the next few days. <br />Mr. Rogers inquired if this could be held in escrow. <br />Discussion ensued as to the fact that this area currently <br />exists as <br />LD -1 on the Comprehensive <br />Land Use Plan, <br />and in <br />DEC 16 <br />198, <br />51 <br />BOOK <br />48 PnF 367 <br />
