Attorney Brandenburg explained that the Attorney <br />for Florida Land Co., developers of the River Bend Yacht <br />Club, objected to the Board entertaining the appeal from the <br />Pelican Audubon Society. He added that concern was <br />expressed that not everyone should have a right to file an <br />appeal - it would have to be an aggrieved party. The <br />Attorney felt this was a close question and hinged on what <br />the Board's intent was in Ordinance 78-10 concerning Site <br />L <br />Plan Approval. <br />Discussion followed on the matter. <br />Motion was made by Commissioner Fletcher, seconded <br />by Commissioner Lyons, that the Board set up a hearing date <br />for February 3, 1982 to hear the Audubon Society appeal of <br />the Planning & Zoning Commission decision on the River Bend <br />Yacht Club, and to discuss the draw bridge question at <br />Jungle Trail. <br />Commissioner Lyons interjected that there was a <br />Board meeting of the State Association of County <br />Commissioners in Daytona on February 3rd in the afternoon, <br />which would present a conflict. <br />Commissioner Fletcher amended his Motion to have <br />the hearing at 9:00 o'clock A.M. on January 27, 1982. <br />Commissioner Lyons amended his second. <br />The Chairman called for the question. It was <br />voted on and carried unanimously. <br />Motion was made by Commissioner Fletcher, seconded <br />by Commissioner Lyons, that the Board authorize staff to <br />advertise for this public hearing. <br />Attorney Brandenburg pointed out that the <br />advertising would be a County expenditure since the County <br />was initiating this matter.
