JAN <br />Mr. Patrick Lyons <br />Chairman of the County Commission <br />1245 - 14th Avenue <br />Vero Beach, Florida 32960 <br />Drawer 3327 <br />Vero Beach, Florida 32960 <br />October 28, 1981 <br />RE: Land Use Plan <br />Tract 10, Section 10, Township 33, Range 38 <br />And that part of Tract 9, Section 10, <br />Township 33, Range 38 lying West of I-95 <br />R/W, less the South 330 ft. thereof. <br />Dear Mr. Lyons: <br />Until today I have been under the impression that the above captioned <br />property was planned for rezoning to MD1, together with the property <br />adjacent to the East and North. The land to the West is planted in <br />citrus and the land to the South is suitable for agricultural zoning, <br />while mine is not for the following reasons: <br />1. The soil is not suitable for agricultural purposes, <br />(white ridge sand in Northeast corner and cypress <br />swamp in Southwest corner). <br />2. Approximately 15 acres of the land is a borrow - <br />pit created at the time of the construction of I-95. <br />3. The Houston Gas Line easement runs through the West <br />portion of the property; diagonally from North to <br />South, taking up approximately 22 to 3 acres on <br />which trees can not be planted even if the soil <br />were suitable for agriculture. <br />I would like to reclaim the property and -perhaps try to work out some <br />mutual plan with the owner to the North which would also give me access <br />to a road without having to travel two to three miles in a "round- <br />about" way to get to the property. Its former access on Rosedale was <br />cut off by the construction of I-95. <br />My impression that it was included in the MD1 area is because it <br />appeared that way on the map which came out in the Press Journal <br />January 7, 1981, and which is enclosed herewith. It was brought <br />to my attention by a Realtor with whom I listed the property for <br />sale, that it was not included in the MDI area in the plan for <br />rezoning. <br />Your kind and courteous attention will be appreciated.
