RELEASE OF CLAIM <br />Attorney Brandenburg explained the claim involving <br />John H. Cann and Irene M. Cann,: his wife vs. Indian River <br />County and Harold Whitaker. He continued that Mr. Cann was <br />a volunteer fireman and he experienced a fall and is now 220 <br />medically disabled. The Attorney added that neither the <br />County -owned truck nor the individual driving the truck, from <br />which Mr. Cann Fell, were insured. <br />3 <br />Commissioner Wodtke interjected that at the time <br />of this accident, Mr. Cann was drawing 100% disability. <br />Discussion followed. <br />Motion was made by Commissioner Lyons, seconded by <br />Commissioner Wodtke, to authorize a General Release for <br />$15,000 to John H. Cann and Irene M. Cann,.his wife; and the <br />funds be allocated as follows: <br />The following budget amendment is necessary to allocate funds to settle an <br />insurance claim due to a 1977 accident. <br />Account No. <br />Account <br />Title <br />Increase Decrease <br />001-101-511-33.16 <br />Insurance <br />Costs <br />15,000. <br />001-199-513-99.91 B.C.Q. Contingencies 15,000. <br />n. <br />Attorney Brandenburg did not think there was any <br />doubt that Mr. Cann was 22% disabled. Mr. Cann was a <br />volunteer fireman on the scene, but they did have some <br />conflicting testimony as to what occurred. The Attorney <br />felt that if this matter went to trial, the award might be <br />greater. He noted that this claim would settle any matter <br />involving the Civil Court action that is pending with the <br />County and the driver. <br />The Chairman called for the question.
