Box 3767 <br />West Palm Beach, FL 33402 <br />Subject: Request for Loan to Purchase <br />Treasure Coast Utilities and <br />Ixora Utilities <br />Dear Mr. Hudnell: <br />Secretary to Board <br />Telephone: (305) 569-1940 <br />This letter is written on behalf of Indian River County, Florida with the <br />intent to request subsequent loan funds for the purchase of the subject <br />utilities which are a part of the Indian River County South Municipal Tax <br />District. The source of loan funds requested would be the approximate <br />1.959 million dollars of remaining obligated water monies and approximate <br />11.0 million dollars of obligated sewer monies which Farmers Home Adminis- <br />tration has set aside for Indian River County. <br />Furthermore, this letter is also to request approval of a procedure to obtain <br />loan funds which would allow Indian River County, Florida, to meet demands <br />placed by the Courts and utility owners and also help to eliminate certain <br />public health problems associated with the subject utilities and thereby <br />eliminate certain legal actions now being pursued by the Florida Department <br />of Environmental Regulation. <br />In an effort to provide you with information necessary to evaluate this <br />request and hopefully issue approval, the following narrative is presented. <br />Treasure Coast Utilities and Ixora Utilities are two private water and sewer <br />franchise systems located within the South County Municipal Taxing District. <br />The Preliminary Engineering Report dated April, 1979 incorporated these two <br />utilities into the proposed South County Water System now under construction. <br />As you are aware, funds for this construction are from Farmers Home Adminis- <br />tration in the form of a $5,825,000 loan and $796,900 grant. Treasure Coast <br />Utilities water system was to be incorporated into the system as part of <br />Phase I of the South County Water System. Ixora Utilities was to be incor- <br />porated into the system at such time as it was feasible. <br />During the past two years, the referenced utilities have been cited by the <br />Florida Department of Environmental Regulation for non-compliance to State and <br />Federal wastewater standards. As a result of the citations, both utilities <br />have been taken to Court. A copy of the complaints filed by the Florida Depart- <br />ment of Environmental Regulation is attached. As a further result of the liti- <br />gation between the referenced utilities and Florida Department of Environmental <br />Regulation, Indian River County has become involved in the litigation.
