City and County may extend the date of County's <br />reconveyance beyond the forty-two (42) months by mutual agreement. <br />The exact date for transfer of retail service responsibility <br />from the City to the County for the South Beach area shall be <br />established based on the City's then existing South Beach utility <br />billing cycle, thus providing complete and accurate customer <br />billing data. City shall retain all customer deposits acquired <br />by City. In the event City holds deposits in excess of those <br />required by the City after transfer, then the excess amounts shall <br />be refunded to customer. <br />County agrees to coo erate with City in the collection of <br />any past -due billings due City and remaining unpaid after County <br />has accepted retail service responsibility. <br />8. Except for the negligence of the other, City and County <br />agree to a joint hold harmless position whereby the City holds <br />the County harmless for any damages and/or injuries which may <br />occur during the period of City retail service and the County <br />holds the City harmless for events that occur after the County <br />has provided retail service to the South Beach area. In enforcing <br />this provision, the prevailing party shall be entitled to reason- <br />able attorney's fees and courts costs. <br />,9. Both parties recognize that there is a potential for <br />annexation within the South Beach area as defined. In the event <br />of annexation by the City, the parties agree that the County shall <br />continue to provide retail water service to all of the customers <br />in the South Beach area whether or not the customer resides in the <br />newly annexed area. Both parties, by mutual agreement, may amend <br />this section at a later date. <br />10. Prior to the County assuming retail service responsibility <br />to the South Beach area, the County shall have installed a booster <br />pump and appropriate two-way interconnection to enable the booster <br />pump to operate in both directions. The pump shall remain in <br />place and in the event of an emergency on either system, the <br />booster pump shall be activated by mutual agreement of each <br />party's delegated authority for the benefit of the system that <br />-6- <br />JAN 2 1982. 49 .630 <br />
