JAN 2 01982 <br />The improvements described in paragraphs 6A, B & C, plus any <br />additional facilities for water service to the South Beach area <br />may be used by the City during the term of this Agreement subject <br />to normal maintenance by City. <br />7. The parties agree to a timetable of forty-two (42) months <br />from the date of this Agreement for the County to construct the <br />proposed subaqueous crossing and be in a position to supply treated <br />water to the South Beach customers on a retail basis as customers <br />of the South County Water System. <br />City, during said 42 -month period, shall continue to provide <br />water service to the South Beach area customers on a retail basis. <br />City shall not be required to provide wholesale service. <br />While customers in the said area are retail water and/or waste- <br />water customers of the City, the City rates and charges for said <br />customers served by the City shall be governed by appropriate City <br />ordinance; -as such may be from time to time amended. City shall <br />deliver to all Beach customers water service and/or wastewater service <br />on an equal and uniform basis without preference for one area over <br />another, subject to the limitations contained in this Agreement and <br />subject to the City's rights to levy rates and charges for service <br />outside the City limits which may be more than such rates and charges <br />for service inside the City limits. <br />19 County shall notify City a minimum of ninety (90) days prior <br />to providing South Beach retail water service through the proposed <br />County subaqueous crossing. this -notice shall not occur later <br />than thirty-nine (39) months from the date of this Agreement. <br />In the event County is unable to provide retail water service <br />to the South Beach through the proposed subaqueous crossing <br />within forty-two (42) months from the date of this Agreement, <br />then County agrees to transfer to the City, free of charge, <br />all assets in existence on the date of this.Agreement as described <br />in paragraph 5, the improvements set forth in paragraph 6, all <br />vested customers, plus two hundred fifty-five (255) additional <br />customers and any remaining unexpended escrow funds plus <br />accrued interest. City shall accept the transfers of the assets <br />and responsibility to service the two hundred fifty-five (255) additional <br />-5- <br />
