In regard to the Audubon Society's complaint <br />about being advised by Planning staff that argument would <br />not be heard, Attorney Henderson noted that was also one of <br />the arguments Florida Land had with the Planning staff; <br />Florida Land did not feel they should be precluded from <br />making a presentation because the Planning Department was <br />not prepared. Attorney Henderson again emphasized that <br />procedural objections, even if true, would have nothing to <br />do with the validity of the presentation. <br />Attorney O'Haire requested that the Board accept all <br />the testimony heard earlier this morning on this appeal and <br />incorporate it as part of the record. He stated the public <br />was not afforded an opportunity to be heard on this matter <br />at any meeting of the Planning and Zoning Commission. <br />Attorney Henderson stated that he did not notice one <br />instance of any denial of an opportunity to speak at the <br />Planning & Zoning meeting and pointed out that the Audubon <br />society was represented by Ann Robinson, who spoke -more than <br />once. <br />Carolyn Eggert, Chairman of the Planning & Zoning <br />Commission, believed it was indicated throughout the <br />Planning & Zoning Minutes that she was having trouble with <br />the procedure of that meeting all along. For some reason it <br />was firmly set in her mind that she had to get a vote on the <br />County Commission policy regarding the proposed cut in <br />Jungle Trail before the Planning & Zoning Commission could <br />proceed with the site plan, and this was also presented to <br />them by the Planning Department who had told a number of <br />organizations not to come and speak before this decision was <br />made. She felt, whatever caused the problem, the public was <br />not called upon to speak. <br />Robert Reider stated vehemently that the public was <br />precluded from giving any input in the hearing before the <br />50 <br />
