7- <br />L <br />Planning & Zoning Commission; he tried to be recognized, but <br />was not, and he was not even allowed to read a letter the <br />Vero Beach Civic Association had addressed to Mrs. Eggert. <br />Mr. Reider noted that, on the other hand, there were nine <br />members of the Florida Land group present to make a "power <br />play;" their presentation went far beyond what normally <br />would be included in a site plan approval; and it was a real <br />"stacked deck." <br />j <br />Attorney Henderson found it incredible for the Chairman <br />of the Planning & Zoning Commission to come before the Board <br />and contend that she ran an unfair hearing. He stated that <br />as an applicant, Florida Land Company had a right to be <br />heard and the opportunity for public participation was <br />there. <br />Commissioner Bird asked if it was Mrs. Eggert's feeling <br />that it was an unusual meeting, and Mrs. Eggert believed it <br />was an unfortunate situation due to lack of information, <br />which she would not want to happen again. <br />Considerable discussion followed as to the basis on <br />which the <br />Board could <br />deny <br />approval <br />of the <br />site <br />plan, and <br />Attorney <br />Brandenburg <br />stated <br />that the <br />Board <br />must <br />look at it <br />from the view of all the County laws and ordinances, and <br />based on what was presented at the Planning & Zoning <br />Commission meeting, as well as at this meeting, determine if <br />the review of the site plan met all county criteria or <br />whether it created a situation detrimental to the health, <br />welfare and safety of the community. <br />Motion was made by Commissioner Lyons, seconded by <br />Commissioner Fletcher, to grant the appeal and deny the Site <br />Plan of River Bend on the basis that evidence presented at <br />the Zoning Commission meeting and the evidence presented <br />today show it to be detrimental to the health, welfare and <br />safety of the community. <br />• <br />51 <br />P -,m 48 PACE757 <br />
