JAN 27 1981 <br />agoK 48 Fai r 662 <br />Chairman Scurlock commented that it is difficult to <br />separate the two agenda items relating to the request for a <br />channel cut on <br />Jungle Trail <br />and <br />the appeal of the River Bend <br />site plan, but <br />he felt that <br />the <br />critical issue which needs <br />to be settled first is whether we do or do not allow the <br />cut. <br />Motion was made by Commissioner Lyons, seconded by <br />Commissioner Fletcher, to deny the request to cut a channel <br />in Jungle Trail. <br />The Chairman believed we should allow public input and <br />let the developer make a presentation. <br />Steve Henderson, Attorney for Florida Land Company, the <br />developer of River Bend, noted that they are not here at <br />this time in regard to`the appeal of their site plan by the <br />Audubon Society, although he realized it is hard to separate <br />the two matters. The marina obviously cannot be developed <br />without either a drawbridge or a cut, and, consequently, <br />they do have technical testimony to present to help the <br />Commission reach a decision. <br />Chairman Scurlock believed the crucial question is the <br />cut regardless of any plans, and he questioned why the Board <br />should allow a cut in a public road for a private use, <br />especially a road with the historic significance of Jungle <br />Trail. <br />Attorney Henderson felt for the Board to be able to <br />make the decision on the proposed cut, they have to weigh <br />what the county is going to give up against what the county <br />has to gain and this is the information they want to <br />provide. <br />Engineer Dale Crosby came before the Board to review <br />Alternate Plan "A" and Alternate Plan "B." <br />14 <br />
