J AN 2 198 �dK 8 pAu 686 <br />RECOMMENDATION <br />Alternative A: Disapprove the site plan as indicated on the design drawings and <br />request Florida Land Company to resubmit the site plan with the modifications <br />recommended by staff. <br />Environmental design recommendation: Staff recommends that the environmental <br />design concerns listed in the "Alternatives and Analysis" section be further <br />addressed by the Department of Environmental Regulation and the Florida Game and <br />Freshwater Fish Commission through the State permitting process. <br />Staff further recommends the Board of County Commissioners submit written approval <br />of the proposed dredge/fill activity after consideration, in a public meeting, of <br />the permit application as described in Chapter 17-A, Florida Administrative Codes. <br />Discussion ensued as to the procedure to be followed on <br />the advertised public hearing since it was felt that with <br />the denial of the channel cut,this had become more or less a <br />moot question. <br />Attorney Brandenburg recommended that the Board allow <br />the Audubon Society to present their appeal, Florida Land to <br />present its rebuttal, and the floor to make comment. He <br />pointed out that although site plan approval was conditioned <br />upon the cut being approved, the site plan still exists on <br />the records, the Audubon Society has presented an <br />appropriate appeal, and he felt the Board should act on it. <br />Commissioner Bird asked if the Audubon Society wished <br />to withdraw its appeal in light of the previous Board <br />action. <br />Ray Fernald, president of the Pelican Island Audubon <br />Society, stated that they do not wish to drop the appeal. <br />He noted that their appeal was based mainly on procedural <br />issues, and he did not see at this point the need to go <br />through several more hours of discussion as to environmental <br />and other impacts; although, they do have the information <br />and expertise available. <br />Attorney O'Haire reaffirmed that the Audubon Society <br />does not want their appeal tabled, but wants it settled for <br />once and all, and they do not propose to present any further <br />testimony. <br />M <br />s � r <br />
