r- I <br />JAN 271982 pOc� 48 F-AGF.688 <br />�41LCMAIFG& 09HAUR119 <br />A=®RA-m--Y .vr LA --w <br />January 27, 1982 <br />Chairman and Members of the <br />Indian River County Commission <br />Vero Beach, FL 32960 <br />Re: Appeal of River Bend Site Plan Approval/ <br />Pelican Island Audobon Society <br />Gentlemen: <br />I am writing you in connection with the appeal taken <br />by our client, the Pelican Island Audobon Society, from what <br />appears to be a contingent approval of site plan granted a <br />projL-ct known as "River Bend", which includes provision for <br />a marina and draw span over the historic Jungle Trail, with <br />substantial dredge and fill operations, and applied for by <br />Robert Cairns, Trustee. As you are no doubt aware, ownership <br />of the property and the true party in interest are uncertain, <br />Florida Land Company and General Development Corporation having <br />taken the posture of the developer. <br />The Pelican Island Audobon Society includes within its <br />membership many persons who live on Jungle Trail or in the <br />vicinity of the proposed development. These members of the <br />Society, as well as the Society itself, have a substantial <br />interest in these proceedings and the proposed development. <br />The aims and goals of the Audobon Society are familiar to <br />everyone, centering on protection, conservation and preservation. <br />The proposed -project, affecting, as it does, substantial wild- <br />life and estaurine habitats is of concern to the Society, <br />especially inasmuch as the proposed project abutts the Inter- <br />coastal Waterway and Class 2 waters, including dredge and fill <br />operations and a potential pollutant source of the Indian River. <br />Additionally, residents of the area, members of the Society, <br />have for many years enjoyed and needed Jungle Trail for access <br />to one of the most historic and scenic areas of the county and <br />to their homes and properties.
