o <br />Chairman and Members of the <br />Indian River County Commission <br />Page Two <br />January 27, 1982 <br />(a) As previously stated, the true identity of the <br />applicant has never been made clear, despite the <br />requirements of the site plan approval ordinance; <br />(b) The site plan being considered was not before and <br />had not been presented to the Commission in final <br />or approved form; <br />(c) The Planning Staff were acknowledgedly unprepared <br />for site plan consideration at the meeting; <br />(d) The public and members of the Society were advised <br />by staff prior to the meeting that this matter would <br />not be considered and then were neither invited <br />nor permitted to be heard. <br />In view of the above and the County's long-standing policy <br />permitting appeals from site plan approval by parties other <br />than the owners and by concerned groups such as the Audobon <br />Society, it is clear that the Society and its members have <br />standing to take this appeal. <br />MO'H/pkm <br />i <br />M <br />Attorney Brandenburg noted that since it appears the <br />I - <br />Board is going to hear the appeal, he would suggest that by <br />Motion the Commission make a part of this appeal and their <br />consideration of it, the Minutes of the meeting of December <br />17th of the Planning & Zoning Commission and also <br />incorporate into this record by reference those evidentiary <br />matters heard earlier today regarding the Trail cut. <br />Commissioner Lyons inquired about the letter written to <br />him on December 23rd by Ray Fernald, president of the <br />Audubon Society, and it was agreed that also should be part <br />of the record. <br />On Motion by Commissioner Fletcher, seconded by <br />Commissioner Lyons, the Board unanimously admitted into the <br />record as testimony the Minutes of the December 17, 1981 <br />meeting of the Planning & Zoning Commission, the letter from <br />41 <br />JAN 27 19�198Z48 FAGF 689 <br />�oo� <br />
