He said <br />the Administrative Code of Florida, Chapter 17-3, stated that, "These <br />rivers either actively or potentially have the capability of supporting <br />recreational or commercial shellfish propagation and harvesting." The <br />Indian River, from the North Relief Canal, North, past the Brevard <br />County Line, was designated as Class II Waters, Mr. Challacombe informed <br />the Board, and his department, along with Mr. Barnett's letter from <br />the Florida Game and Fresh Water Fish Commission,expressed.concerns for <br />this designated area, and they had not received adequate information <br />from Florida Land about these concerns. <br />Mr. Challacombe also listed the concerns__over the heavy <br />metals that the proper paint found on the bottom'of boats would have on <br />a lot of grasses on the river bottom; this too had not been answered to <br />their satisfaction. <br />Mr. Parent questioned Mr. Challacombe as to these four <br />technicalities being the only "hang ups" other than the drawbridge and <br />loop road; and Mr. Challacombe answered that they were. <br />Mr. Henderson stood up and said the basic response was, <br />"Nice.of you to let us.know." lie said the information they had submitted <br />had been earlier in the month and they never heard "one -iota" of a <br />complaint out of the Planning staff, regarding inadequacy. <br />The Chairman asked if this hadn't been discussed at the <br />joint meeting held earlier in the month; and Mr. Henderson responded saying <br />after that meeting; the requests that were made, were responded to, and <br />they were not advised at all that the Planning Department was still <br />considering their response, inadequate, till now. <br />Mr. Henderson said,however, they did have a response to <br />the letter in the form of the environmentalist who was present with them <br />now; a real live person, instead of a letter; and felt this would be a <br />good time to present him to the Board. <br />Mr. Jones injected he had one question he would first like <br />to ask the Planning Department; if a marina basin was a source of pollut- <br />ant in Class II Waters, he wondered if the apparent implications of the <br />contradiction between not having enough flushing action, and therefore <br />creating a polluted pond; versus having enough flushing action could there- <br />fore be rated as Class II Waters existing outside of the marina? <br />-20- <br />
