On Motion by Commissioner Bird, seconded by <br />Commissioner Lyons, the Board unanimously closed the public <br />hearing. <br />Commissioner Bird stated that he would like to have <br />more discussion regarding the negotiation of the franchise. <br />Attorney Brandenburg commented that the Special <br />Act was adopted back in 1959; the County has changed dramatically <br />since then, and this would be the time to write some additional <br />safeguards into the franchise. The Attorney continued that <br />if the Board desired to pursue this matter, then the Board <br />should give tentative approval to the transfer today, subject <br />to staff reworking the agreement as soon as possible. <br />Commissioner Bird felt that if they were going to <br />collect trash here, it must be deposited in our Landfill; no <br />waste from other counties should be put in our Landfill. <br />Attorney Bergerson advised that Waste Management' <br />would not have any objection. <br />Lengthy discussion followed regarding the <br />agreement. <br />The Attorney suggested that if the Board takes <br />action today, take it subject to the negotiations of the <br />modifications by Administrator and the Attorney. <br />Commissioner Bird stated that they are still <br />operating under whatever the franchise agreement was with <br />Indian River Sanitation and Rural Sanitation. <br />Attorney Brandenburg stated that the Board can <br />require a modification of that franchise; this would <br />guarantee the County additional safeguards. <br />Commissioner Fletcher felt the Board could go <br />through the licensing aspect instead of a franchise, and <br />would like to see the Board discuss this with Waste <br />Management. <br />FEB 21982 <br />37 <br />
