FEB 1��2 BOOK 8 PDGF 80 <br />Commissioner Lyons stated he felt uncomfortable <br />but the record was clear; he had no valid reason for not <br />voting for transfer of the franchise. <br />Commissioner Wodtke noted that there was nothing <br />in this agreement stating that they will be going to our <br />dump; also we must know what the charges would be. He <br />stressed he would not vote for an outright franchise without <br />renegotiating it. Commissioner Wodtke stated that he was <br />not happy with Waste Management. He would like to have the <br />opportunity to negotiate with them and put some things in <br />writing in order to protect the County and the Landfill. <br />Chairman Scurlock stated that he had some <br />questions in his mind, although he had yet to see any <br />documentation that anything was wrong with this company. He <br />would vote in favor of a transfer but would want to make <br />sure, through the negotiation process, that any potential <br />problems would be addressed, such as "duration," and to <br />protect our ability in the future to handle waste in the <br />County. <br />Discussion ensued. <br />Attorney Brandenbug suggested using the phrase <br />"tentative approval" in the Motion. <br />Motion was made by Commissioner Lyons, seconded by <br />Commissioner Bird, that the Board authorize tentative <br />approval of the transfer of the franchise agreement subject <br />to successful modificdtion of the franchise, and an update <br />of it to be presented to the Board within 120- days. <br />Commissioner Lyons personally thought that the <br />franchise was the way to go in this transaction. <br />Commissioner Fletcher stated he would like to see <br />other alternatives used. He stated he would vote against <br />the Motion based on the single line direction. <br />Attorney Brandenburg pointed out that the <br />discussion involved having either a contract, a franchise, <br />and the third alternative was a licensing ordinance. <br />
