Nelson <br />/'County Administrator <br />SUBJECT: Transient _Merchant Ordinance <br />REFERENCES: <br />DESCRIPTION AND CONDITIONS <br />On July 14, 1981, Lawrence A. Barkett representing the Vero Beach, <br />Indian River County Chamber of Commerce submitted correspondence <br />requesting that the Board consider adopting an ordinance preventing <br />truck type sales of food and other merchandise in the County. <br />Since that time the County Staff, to include members of the County's <br />Legal Staff,have worked very closely with Mr. Barkett and other members <br />of the Chamber of Commerce in an effort to reach_a mutually sat- <br />isfactory ordinance dealing with this particular problem. The <br />matter has been discussed on several occasions to include recent <br />County Commission meetings wherein it was determined that the <br />initially proposed ordinance needed revision. Staff has worked <br />toward that end and believes that the proposed ordinance presented <br />for your consideration reflects the necessary changes as had been <br />earlier indicated. The proposed ordinance has been duly advertised <br />in the Press Journal on January 28, 1982 and again on February 10, <br />1982 and is appropriate for your consideration. <br />ALTERNATIVES AND ANALYSIS <br />A. Affirmative vote by the Commission to adopt a Transient Merchant <br />Ordinance will accomplish the following purposes: <br />1 It will require merchants to obtain a local or county license <br />in order to operate. It will control location of transient <br />merchant activities and indicate specific areas that are <br />properly zoned in which this type of activity may be con- <br />ducted. It will provide a fee structure for the obtaining <br />of an occupational license to conduct oneself as a <br />transient merchant thus providing for the sharing in the <br />tax burden by the transient merchant. It will also establish <br />through the zoning process better control of traffic and over- <br />all locational issues involving the activity. <br />B. Not to adopt the Transient Merchant Ordinance will allow for the <br />continuation of present conditions wherein the County's Staff <br />as well as the Chamber of Commerce receives numerous complaints <br />from residents involving problems associated with the purchase <br />of goods and/or services from transient merchants. In addition <br />to that there are also traffic hazards and additional items <br />of which Staff and/or the Chamber of Commerce is made aware of <br />dealing with this particular issue. <br />RECOMMENDATIONS <br />It is Staffs recommendation that the Board of County Commissioners <br />adopt the ordinance as a necessary, vehicle in order to address the <br />issues involving the regulation of transient merchants. <br />37 <br />FEB 171982 <br />sax <br />FA E 866 <br />
