FEB 171982 <br />am 4 8 PA.;E <br />Attorney Brandenburg informed the Board that there is a <br />typographical error on the bottom line of page 1 of the <br />proposed ordinance, and B) should read "Any person who sells <br />his or her own property which was not acquired for resale, <br />barter <br />11 <br />Discussion arose as to allowing any display or sale of <br />merchandise within the County right-of-way and the possible <br />liability that could result from such activity. Attorney <br />Brandenburg stated that the Commission can prohibit this <br />from taking place in the right-of-way. <br />Commissioner Lyons discussed Page 1, Section 1, <br />Paragraph 1, which is the definition of Transient Merchant, <br />and brought up the question of the ice cream wagon vendor, <br />whose business necessarily takes place in the right-of-way. <br />Commissioner Wodtke felt such merchants really are <br />operating on a permanent basis of vending to construction <br />sites and up and down streets, etc. In addition, they are <br />licensed by the Health Department. <br />Zoning Director Walker commented that the intent of the <br />ordinance is to regulate areas where transients may locate, <br />and an ice cream truck is a moving object, which would be <br />licensed differently than a transient merchant who sets up <br />along side of the road. <br />Commissioner Fletcher wished to know what would be <br />required of individuals to validate the zoning of the <br />property which they intend to use, and Mr. Walker stated <br />they will have to supply a legal description of where they <br />set up, a deed, permission from the owner, etc., which they <br />probably can obtain from the Recording Department in the <br />Courthouse. <br />The Chairman asked if anyone present wished to be <br />heard. <br />Attorney Lawrence Barkett, came before the Board <br />representing the Chamber of Commerce, and informed the Board <br />38 <br />
