He preferred to have the ordinance written so <br />that the Sheriff's Department can make a determination of <br />whether this is a legitimate activity and then give the <br />individual the chance to buy the license on the spot. <br />Commissioner Wodtke pointed out that we must give the <br />Sheriff something he can enforce, and he believed we need to <br />adopt an ordinance that says this activity will take place <br />on a specific type of property and that it must be off the <br />right-of-way. He brought up complaints he has had about the <br />trakfic hazard caused by flea markets. Commissioner Wodtke <br />pointed out that anyone who wants to can have a garage sale <br />in their home, and he asked Commissioner Fletcher what he <br />wanted to change in the ordinance. <br />Commissioner Fletcher believed that an ordinance <br />dealing with the right-of-way hazards would take away 90% of <br />the problem, and he was of the opinion that limiting garage <br />sales to three times a year is a problem. <br />Commissioner Wodtke pointed out that the average person <br />does not have enough items of their own to conduct a sale <br />more than three times a year, and if they are bringing other <br />material in, it should be handled as a commercial operation. <br />Attorney Barkett deported that the Chamber of Commerce <br />has received many complaints of transient merchants. He <br />further noted that when you go to a flea market, 50% of the <br />merchandise you see is new, not used, and this is in direct <br />competition with the local merchants, who are our tax base. <br />He emphasized that everybody in the selling game should be <br />on an equal basis, and if you are going to deregulate, you <br />must include the local merchants.
