1 �s <br />MAR 31982 <br />Lengthy discussion followed about filling in 5' on <br />the north side of the pond where the right-of-way would <br />be located. <br />Mr. Beindorf explained that to do work such as this, <br />a DER permit would have to be obtained - they felt this would <br />be an undue burden. <br />After a brief discussion concerning dedicating rights- <br />of-way and easements, it was determined that a dedication <br />of the road right-of-way could be a condition of the <br />preliminary plat approval. <br />Motion was made by Commissioner Lyons, seconded by <br />Commissioner Fletcher, that the Board reject the preliminary <br />plat approval on the basis that it does not include the <br />required right-of-way on 10th Street. <br />The Attorney stated the Board could approve it subject <br />to the developer redoing the plat to show the right-of-way <br />dedication. <br />Commissioner Lyons withdrew his Motion, and Commissioner <br />Fletcher withdrew his second. <br />Motion was made by Commissioner Lyons, seconded by <br />Commissioner Wodtke, that the Board approve the request for <br />preliminary plat approval for Hidden Hammock Subdivision, <br />with the understanding that the County would receive a 15' <br />right-of-way on 10th Street; and that the existing structure <br />would be removed prior to final plat approval. <br />Commissioner Fletcher stated that, based on the same <br />criteria that the density was too heavy, he would be voting <br />in opposition. <br />The Chairman called for the question. It was voted <br />on and carried with a vote of 4 to 1, with Commissioner <br />Fletcher voting in opposition. <br />
