He added that his client had no desire to connect with <br />10th Street and felt there was no need to connect to any <br />other streets. Mr. Beindorf commented that if a right-of-way <br />was required, his client felt it should be in the form of <br />an easement. <br />Engineer Jim Davis reviewed the staff's position on <br />the five items in the memorandum. He added that he tried <br />to use a non -arbitrary standard, and used the D.O.T. Greenbook. <br />Mr. Davis reported that the State Association of Counties <br />recently made a statement that the Greenbook should not be <br />used to do private subdivisions, and he agreed with this <br />statement. However, he was not sure of the liability <br />implications and Mr. Davis felt he needed some direction <br />from the Board. <br />Attorney Brandenburg interjected that the best suggestion <br />would be for the County to adopt what they felt was safe, <br />and then live with those standards. <br />Commissioner Wodtke thought they needed to have some <br />flexibility in a private subdivision and let it be known <br />that the County would not be maintaining the private road - <br />it would be the responsibility of the property owners in <br />the subdivision that the road Would forever be their <br />responsibility. <br />Commissioner Bird stated he would be agreeable to <br />accepting a variance and suggested the Attorney and the <br />Engineer could come up with some sort of wording to put <br />on the plat concerning the private road. <br />Dennis Ragsdale, Planner, discussed the existing <br />residence that was located 10' from the proposed right-of-way. <br />Mr. Beindorf indicated that the owner planned to <br />eventually demolish the structure in question. <br />Mr. Ragsdale pointed.out that they would need a variance <br />until the structure was demolished. <br />MAR 3 1982 <br />31 <br />wK ent <br />
