Zorc to Neil Nelson ,dated <br />Feb. 3, 1982 <br />On July 20, 1981, Mr. Frank Zorc, developer of Colonial Heights Subdivision <br />located west of Old Dixie Highway and south of 8th Street, submitted an $8,780. <br />cash maintenance performance bond to cover the burning/removal of cleared material; <br />seeding and germination of grass in swale and easement areas, and the installation <br />of traffic control signs within the development. This bond was approved by the <br />Board of County Commissioners as a condition of granting Final Plat Approval on <br />July -15, 1981. By copy�oof the ,above referenced letter, Mr. Zorc is -requesting <br />release of this bond. <br />ALTERNATIVES AND ANALYSIS <br />Inspection by the Public Works Department on Feb. 25, 1982 revealed that <br />seeding germination does not exist in the following areas: <br />1) Along 6th Place west of Old Dixie Hwy. Approx. 6000 S.F. <br />2) At the intersection of 6th Street and 9th Avenue - Approx. 6000 S.F. <br />3) At the intersection of 6th Street and 9 Ct. - Approx. 6000 S.F. _ <br />4) Within the side. lots easements between lots 9 and 10 and beti;een lots <br />14 and 15 - approx 10,000 S.F. <br />Total area = Approx. 28,000 S.F. <br />Mr. Zorc was notified of this matter, however, he states that seeding <br />was performed and the severe drought weather has impaired the permanent rooting <br />of the seed. Mr. Zorc claims that the -work covered by the Bond was all accom- <br />plished, and that the $8,780. amount should be released so that the Contractor, <br />Trodglen Co. can be paid for the work. He also states that any maintenance <br />required by the developer, i.e. reseeding or sodding, will be perfoimcd by him <br />when improved weather conditions prevail. <br />In analysing the areas that have not germinated, approximately $3000. <br />would cover regrassing even if sod is required for erosion protection. <br />The following alternatives are presented: <br />Alternative No. 1 <br />Release to Mr. Zorc $5,780.*of the bond which represents that portion <br />of the work complete and acceptable. The remaining $3,000. should be retained <br />by the County until the proper erosion control exists. <br />
