Therefore, the county staff has recommended to the Board that the $747.35 per <br />unit (for 41 units totalling $30,641.35) be paid from the impact fees received from <br />Harbour Island Club. The balance is to be retained in the Impact Fund. <br />If you have any question on this, please call me or Tommy Thomas or Gary Brandenburg <br />Sincerely, <br />George Liner <br />Utilities Director <br />Attorney O'Haire pointed out that the excess in <br />question is not the County's money and fairness dictates <br />that his clients get their money back. <br />No one else from the audience wished to be heard. <br />On Motion by Commissioner Lyons, seconded by <br />Commissioner Wodtke, the Board unanimously closed the public , <br />hearing. <br />Question arose as to where we get the extra $6,000 to <br />make up the shortfall, and Assistant Administrator Greene <br />stated that there would not be a shortfall; Harbour Island <br />Club has paid in $36,000, and at this point the County is <br />$6,000 ahead according to Attorney O'Haire's argument. He <br />continued that under the agreement entered into in 1980, <br />Harbour Island Club agreed to pay $900 per unit, which <br />included consideration to an impact fee; so, staff's <br />position is either they pay the $747 plus today's rate of <br />impact fee or we accept the $900 and not give the rebate. <br />Motion was. made by Commissioner Lyons, seconded by <br />Commissioner Bird, to refund Harbour Island Club the <br />difference between $36,000 and $30,641.35, or $5,358.65. <br />Commissioner Wodtke noted that the former Commission <br />met with this developer many times in this regard; the <br />figure of $900 per unit was agreed upon; they were allowed <br />to start development much sooner than would have been <br />possible otherwise; and he did not feel they are entitled to <br />any refund_. <br />53 <br />APR 71982 <br />I <br />NOX 49 PAR 320 <br />
