Attorney O'Haire then proceeded to review the history <br />of the situation, stating that the records prove beyond a <br />doubt that Quay dock Road is a public road all the way to <br />the river. He cited the following as proof of his <br />statement: <br />1) 1908 - A resolution of St. Lucie County designating <br />Quay Dock Road as a public road. <br />2) 1915 - Acquisition of property on Quay dock Road by the <br />Baptist Church. <br />3) 1916 - Widening of the road by 10' by a Board of Road <br />Commissioners. <br />4) 1916 - Designation of Quay dock Road as a public road <br />by Indian River County. <br />5) 1920 - Survey of Quay Dock Road by Harry4Damerow, <br />recorded in Plat Book 4, Page 6: .` <br />6) 1933 - Survey of the road showing a 60' R/W by Major <br />Clarkson - obtained from the Property Appraiser's <br />office. <br />7) 1936 - Mapping of Quay Dock Road as a public road by <br />the federal and state governments. <br />8) 1940 - Navy aerials showing Quay Dock Road. <br />9) 1941 - Designation by the Legislature as a state r ad. <br />10) 1949 -,Geodetic survey. <br />Attorney O'Haire emphasized that, in addition to all <br />this evidence, -there are about 60"people present today who <br />personally know, as their fathers knew, that Quay Dock Road <br />is a public road, and they are bewildered by the suggestion <br />that they should compromise when the road belongs to the <br />public. Attorney O'Haire emphasized that the County is <br />responsible for maintaining and protecting what belongs to <br />the County, and the people are asking the Commission to <br />pledge that the county will fight for the preservation of <br />Quay Dock Road to its full historical extent. <br />Commissioner Bird asked how our survey complies or <br />differs from what Attorney O'Haire feels are the wishes of <br />those he represents, and Attorney O'Haire stated that the <br />APR 71982 49 P* 34 <br />
