County Administrator Joint Pole Use Agreement <br />FROM: James W. Davis P. E REFERENCES: <br />Public Works Director <br />DESCRIPTION AND CONDITIONS <br />Florida Power and Light Company has requested that the County enter into a <br />Joint Use Agreement which gives the County the right to attach traffic signals <br />to F.P.L. poles. The attached agreement states that attachments will be main- <br />tained in a safe condition, that the County will indemnify the owner of any <br />liability due to the County's facilities, and ttthe County will bear the <br />cost of rearranging it's facilities if neces!ia.ry. This agreement is necessary <br />to allow the -flashing beacoq installation at 8th Street and 27th Avenue. <br />ALTERXATIVES AND ANALYSIS <br />Presently, the County appears to use two F.P.L. poles to support traffic <br />signals. These poles are located at Oslo Road and 27th Avenue and at 12th <br />Street and 27th Avenue. The 8th Street and 27th Avenue installation will be <br />the third such case. <br />The County Attorney's office has reviewed the attached agreement and has <br />several comments concerning the County's obligations. However, since only <br />3 poles are considered, the Attorney's office has stated that the County could <br />enter into this agreement, but prior to future installations, the County - <br />should renegotiate an agreement with F.P.L. <br />RECMENDATIONS AND FUNDING <br />It is recommended that the following motion be presented and approved: <br />1. That the Board of County Commissioners approve the Joint Use <br />Agreement. <br />2. That the Board authorize the Chairman'to execute said agreement <br />on behalf of the citizens of Indian River County. <br />No funding is applicable. <br />Motion was made by Commissioner Lyons, seconded by <br />Commissioner Bird, that the Board approve the Joint Pole <br />Use Agreement and authorize the signature of the Chairman. <br />Lengthy discussion followed concerning the agreement. <br />
