r 890K 49 <br />MAY 51982 <br />RESOLUTION 82-49 - RE PUBLIC NECESSITY FOR ACQUISITION OF 8TH <br />STREET EXTENSION RIGHT-OF-WAY <br />The Board reviewed the following memo from the Assistant <br />County Attorney: <br />TO: Chairman Don C. Scurlock,JrPATE: April 26, 1982 FILE: <br />and Members of the Board <br />of County Commissioners <br />SUBJECT: Resolution Declaring Public <br />Necessity for Acquisition <br />of 8th Street Extension <br />Right -of -Way. , <br />FROM: Christopher J. Paull REFERENCES: <br />Assistant County At4ornM <br />Negotiations for the acquisition of three parcels of land just east <br />of U. S. Highway #1 for needed 8th Street right-of-way have been <br />undertaken, off and on., with limited success over the past thirteen <br />(13) months. Each of the individuals was contacted as far back as <br />March, 1981 by past County Attorney, George G. Collins, Jr. This <br />office has resumed the negotiations and has tentatively reached <br />agreement for purchase of one of the three parcels, and is <br />continuing negotiation on the other two. <br />_ The two parcels remaining subject to negotiation abut U. S. Highway <br />#1, to wit: <br />Parcel A - Owner; Lawrence C. and Joyce R. Wright (the north <br />thirty (301) feet of a 2.03 acre parcel) <br />Parcel B - Owner, Mr. C. L. LaFevers, Sr. (the south <br />thirty-five (351) feet of a 7 acre parcel known as Lot 8 of <br />Vero Land Company Subdivision) <br />Each of these owners has been offered, but neither has yet <br />accepted, the full fair market value as determined by appraisals <br />prepared for the County by Mr. Peter Armfield, thereby indicating <br />that condemnation may be necessary to close on these acquisitions. <br />There exists a fifteen (15') foot strip running along the south <br />edge of Paro-el Be the o -rohip 0.1 which has yet tz be determined. <br />Until recently, it was assumed by all parties that this was a part <br />of Parcel B. Parcel B is the remainder of Lot 8 of the original <br />Vero Land Company Subdivision, which plat also designated the south <br />fifteen (151) feet of the platted properties for possible right-of- <br />way or access purposes, although there was no precise dedication <br />stated on the face of the plat. In the event this fifteen (15') <br />foot hiatus wa-s purposely dedicated to the public, the County <br />should at this time accept that dedication by formal action. In <br />any event, the fifteen (151) foot hiatus will be named in the <br />condemnation as part of the subject property in order to quiet <br />title in the County. <br />W. <br />
