Requested Action <br />Because of the pending completion dates of engineering and con- <br />struction work for this project (Project #8101 --Engineering comple- <br />tion date 5/30/82; Construction completion date 10/31/82), this <br />office is requesting that formal action be taken at this time by <br />the Board of County Commissioners to adopt a resolution which <br />expresses in detail the public necessity for extension of 8th <br />Street and authorizes all necessary steps and expenditures related <br />to condemnation of the remaining parcels. The substance of this <br />resolution will be a necessary element to be proved by the County <br />in the condemnation proceeding. <br />Assistant County Attorney Paull reported that, as authorized <br />in December of 1980, acquisition of the right-of-way for <br />extension of 8th Street has been pursued. A request for donation <br />of the right-of-way was turned down by all three owners. They <br />now have been offered a fair market value as appraised, and this <br />value ($18,260) has been accepted by Mr. Hammond, owner of Parcel <br />C, the smallest of the parcels involved. Attorney Paull <br />requested that the Board consider adoption of a resolution that <br />will set out the public necessity for this right-of-way so that <br />it can be used in a petition for condemnation, if necessary, and <br />further requested that he be authorized to enter into a purchase <br />agreement with Jerry Hammond, the owner of Parcel C. <br />Commissioner Bird questioned the wisdom of entering into any <br />agreement prior to being assured we will be able to obtain the <br />remaining right-of-way, and Mr. Paull stated that any conveyance <br />would be made subject to the County obtaining the other property. <br />Commissioner Wodtke entered the meeting at 2:05 o'clock P.M. <br />Motion was made by Commissioner Lyons, seconded by <br />Commissioner Bird, to adopt Resolution 82-49 declaring the <br />acquisition of certain parcels ofproperty for right-of-way <br />purposes for the extension of 8th Street to be a public necessity <br />and authorizing the preparation and prosecution of eminent domain <br />proceedings. <br />Commissioner Fletcher discussed the possibility of <br />increasing our bargaining position by looking for right-of-way <br />somewhere where the people are more receptive.
