NAY 51982 tank 49 PAGE"56. 0 <br />Commissioner Wodtke brought up Section 7 on Page 6 - <br />Utilities Accounts Receivable - in regard to the seller reading <br />the meters on or about the date of closing, and emphasized that <br />it would be absolutely necessary that the County also read the <br />meters at the same time. <br />Considerable discussion ensued about disposition of the <br />customer utility deposits, and Attorney Brandenburg noted that <br />Ixora Utilities wants to keep the deposits 60 days to protect <br />themselves against unpaid bills. Commissioner Lyons felt if the. <br />County requires a deposit, it is an entirely separate matter from <br />this agreement. <br />Chairman Scurlock agreed this is a very delicate situation, <br />and believed if there is too much publicity about transfer of the <br />systeml-you then encourage people not to pay their bills. <br />Attorney Brandenburg stated that he did not feel it would be <br />wise for the County to buy the accounts receivable and be <br />responsible for collecting Ixora's bills. On the other hand, <br />Ixora did not wish to walk away from those bills and wanted to <br />keep the deposits as a protection. <br />Lengthy discussion continued as to how to handle the utility <br />deposits, and Commissioner Lyons emphasized that we can set a <br />policy with our customers, and he did not feel this should <br />complicate our agreement with Ixora. <br />Chairman Scurlock commented that this was all worked out and <br />he did not believe any other language would be suitable. <br />Question arose as to interest on the deposits, and Attorney <br />Brandenburg explained that the company is required to give an <br />affidavit as to the deposits and the amount of interest they have <br />accrued, and, in addition, they must indemnify the County for any <br />mistakes made in the affidavit. This is set out in Paragraph 9. <br />The Chairman called for the question. It was voted on <br />and carried 4 to 1 with Commissioner Fletcher voting in <br />opposition. <br />
