Brandenburg REFERENCES: <br />County Attorney <br />The Board of County Commissioners has previously considered and <br />approved, subject to renegotiation of the franchise agreement, the <br />transfer of the Adian River Sanitation franchise to Waste <br />Management of Florida, Inc. The County Commission also instructed <br />this office to contact and negotiate an updated franchise agreement <br />with Rural Sanitation Service. Attached to -this memorandum please <br />find drafts of the proposed resolutions together with comments from <br />the respective companys' attorneys and my responses to the <br />comments. The franchises granted by the proposed resolutions <br />contain the same terms for each company. These franchises place <br />both companies onto an equal footing in an effort to promote <br />competition and hopefully enhance service. The proposed franchises <br />provide for; <br />1. Non-exclusive franchise areas allowing both companies to <br />operate in the entire unincorporated area. Formerly Indian <br />River Sanitation was for the entire unincorporated area whereas <br />Rural Sanitation franchise area was somewhat limited. <br />2. The franchises are for a period of twenty years and provide <br />that the County can hold a public hearing at any time to <br />receive input on the company's performance under the franchise. <br />Formerly, Rural Sanitation's franchise was granted in 1961 and <br />had a thirty year life to expire in 1991. Indian River <br />Sanitation's franchise was granted in 1975 for a term of thirty <br />years to extend to the year 2005. <br />3. The County retains the right to adopt additional reasonable <br />rules and regulations to provide for changing needs of the <br />County over the twenty year life of the franchise agreements. <br />4. The franchise sets residential rates only. The current rates <br />of $7.00 per month/two collections per week are contained in <br />these franchise agreements. <br />5. The proposals update the insurance requirements under the old <br />franchises. <br />6. The franchises require the companies to pay to the County 5% of <br />gross revenues as a franchise fee. <br />7.
