He, therefore, suggested that we ask the <br />Zoning Board to take a look at the home manufacturing <br />definition and make a recommendation, and in the meantime, <br />authorize the Attorney to instigate the suit as he did not <br />W. <br />believe we have any other alternative. <br />Attorney Brandenburg noted that if Mr. Herold were to <br />terminate his activities for 90 days until the review could <br />be completed, he would not be in violation and we would not <br />have to file suit. <br />Carolyn Eggert, Chairman of the Planning & Zoning <br />Commission, reported that within 120 days the new <br />implementing ordinance of the Comprehensive Plan should be <br />available, and this is part of what they have been working <br />on. <br />Discussion followed as to the possibility of them <br />addressing home occupation on a separate basis, but Mrs. <br />Eggert felt this would be a hardship to the Planning <br />Department and throw them off schedule. <br />Chairman Scurlock felt if the Board took the approach <br />of doing nothing, we could be in the position of having a <br />suit filed against us for not taking action. <br />Commissioner Bird asked Mr. Herold about the <br />possibility of his ceasing operations for the time period <br />suggested by Attorney Brandenburg. <br />Mr. Herold confirmed the feeling expressed that this is <br />actually a neighborhood squabble, but stated that he would <br />like to ask the Board of Adjustment for a rehearing, if <br />possible, since he was only informed on a Friday night that <br />there would be a hearing on the following Monday.
