desire to have an air strip convenient to the subdivision. <br />Mr. Walker agreed that argument apparently has arisen among <br />the residents as a result of some deed restrictions, but <br />that is not our problem - manufacturing is our problem, and <br />there is a noise problem which has caused objections. The <br />people have looked at the laws and have come to us, and we <br />must either enforce the laws or change them. <br />Commissioner Wodtke felt that Mr. Walker is indicating <br />that it is the manufacturing which is the problem and even <br />if there were no external noise or vehicular traffic, Mr. <br />Herold still would-be in violation. Mr. Walker confirmed <br />that was his opinion. <br />Considerable discussion followed as to the fact that <br />the Commissioners took an oath to uphold the law and they do <br />not have the authority either to overturn the decision of <br />the Board of Zoning Adjustment or just disregard this <br />violation. <br />Commissioner Lyons asked if there is a set time in <br />which the Board must take action, and Attorney Brandenburg <br />stated that Mr. Herold is in violation now, and it is the <br />matter of a continuing violation and how quickly the County <br />will act to enjoin the violation. If it goes to court, the <br />Judge will make the decision. <br />Commissioner Bird suggested some sort of compromise <br />where we do not immediately initiate court action for Mr. <br />Herold to cease his operation, but begin a study of that <br />portion of our regulations that pertain to home occupations <br />in an Agricultural zone. <br />Lengthy discussion ensued on how you would define home <br />occupation; the dividing line between manufacturing and home <br />occupation, etc. <br />Commissioner Lyons pointed out that the present <br />definition had been arrived at through a lot of hard work, <br />
