�K :� P 75-8 <br />MAY, -1-9:1982 <br />Mr. Paull commented that we are faced with an apparent <br />violation, and we have been requested to enforce the law. <br />Zoning Director Dewey Walker did not see how the Board <br />could question the definition spelled out in their own <br />regulations, which clearly states that you cannot <br />manufacture in that district and sell off premises. He <br />agreed there is no problem with anyone building cabinets for <br />his own house, and Mr. Herold does sometimes go out and <br />build cabinets on the job in people's houses, which is <br />permitted. Mr. Walker pointed out that the Commission gave <br />the Board of Adjustment the authority to render decisions on <br />the Zoning Code, and they have determined that the <br />manufacture of kitchen cabinets in an agricultural zone does <br />not come under the classification of home occupation. He <br />believed if the Commission changed the regulations to allow <br />manufacturing under the definition of home occupation, it <br />would open up a can of worms for the County, and we could <br />end up with someone with a 4 -car garage manufacturing <br />go-carts. Mr. Walker stressed the fact that Mr. Herold is <br />retailing and he does have deliveries to his house. <br />Commissioner Wodtke asked what about a situation where <br />a lady makes ceramics in her home and sells them, and <br />Mr.Walker commented that if it is a violation, it will be <br />closed down. <br />The Board continued to review the factors used in <br />determining whether or not something is a home occupation. <br />Commissioner Lyons felt the neighbors would expect the <br />law to be maintained, and Commissioner Wodtke noted that <br />most of the people out there have no problem and it seems <br />this whole problem is the result of a neighborhood argument. <br />Mr. Walker commented that when we think.of an <br />agricultural zone, we generally think of 5 acre lots. This, <br />however, is a subdivision of one acre lots in an <br />agricultural zone, which came about because of the residents <br />
