Brandenburg <br />County Attorney <br />191#E827 <br />: { <br />DATE: May 11, 1982 FILE: <br />SUBJECT: Quay Dock Road <br />REFERENCES: <br />Mr. Holmes has commenced Case No. 82-67 in the Circuit Court for <br />Indian River County. This law suit is an attempt to end a dispute <br />that has been ongoing for many years over the ownership of the por- <br />tion of Quay Dock -Road that runs through Government Lot 3 to its <br />point of intersection with the Indian River. The County Attorney, <br />County Administrator and County Engineer have met with Mr. <br />Roddenberry, attorney for Mr. Holmes, and Mr. Telkamp, the property <br />owner to the north, in an effort to resolve the dispute and forever <br />put to rest the questions involved. The letter attached to this <br />memorandum represents a proposal from the concerned property <br />owners. The proposal is as follows: <br />A. Mr. Telkamp will convey by quit claim deed all property lying <br />25' north of the center line of Quay Dock Road. This will <br />forever settle the ownership of the north one-half of the road- <br />way. <br />B. Mr. Telkamp will convey by quit claim deed the property located <br />beyond the end of the pavement extending to the Indian River <br />south of the drainage ditch and north of the Holmes/Telkamp <br />line. This will forever settle the question of access all the <br />way to the Indian River. This also corresponds to the historic <br />route to the old dock. <br />C. The County will improve and maintain the drainage ditch on the <br />north side of the road (requiring work on approximately the <br />last 1001). This is desirable from the County standpoint of <br />improving drainage in the area. <br />D. The County will culvert the ditch on the north side of Quay <br />Dock Road at a point which would provide convenient access to <br />the northern property. This culverting is necessary as clear- <br />ing and deepening of the ditch will make it impossible for the <br />north property owner to reach his property. <br />E. Provide a turnaround on the north side of the road lined with <br />cutoff telephone poles or other appropriate traffic channeling <br />devices (provide culvert in ditch if,necessary) to provide <br />enough space for a turnaround. <br />F. Agree that the area between the terminus of the road and the <br />Indian River be left in the same natural condition that it has <br />been in for the last forty years. <br />G. Accept a drainage easement from Mr. Holmes for the ditch on the <br />south side of Quay Dock Road. <br />H. Place a culverted turnaround at the southern side of the <br />intersection of Government Lot 3 and Quay Dock Road. This will <br />provide a means of turnaround for individuals who do not desire <br />to go all the way to the river. <br />i <br />
