Brandenburg <br />County Attorney <br />QfN( 50 fisc. fl <br />DATE: June 3, 1982 FILE: <br />SUBJECT: Insurance Limits on <br />Garbage Franchises <br />REFERENCES: <br />The County Commission during the meeting of May 19, 1982, approved <br />two garbage franchises. During the discussions, one of the <br />companies suggested that the new insurance requirements were too <br />high and costly and were not necessary. Consequently, the Board <br />adopted the franchise with a provision that current limits of <br />$100,000/$300,000--$1,000,000 stay in effect for 30 days; and <br />unless the company is notified to the contrary, the limits would <br />automatically increase to that suggested by this -office. In the <br />interim, this office was requested to contact an insurance agent <br />for a recommendation. <br />SubsegAent to the meeting, I contacted Bob Jackson, attorney for <br />Rural Sanitation; and he suggested that Mr. Hamilton G. Arden, Jr. <br />would be the best source of such a recommendation. Mr. Arden's <br />recommendation is attached to this letter and is self- <br />explanatory. <br />I would recommend that the County Commission allow the rates to <br />automatically increase to the amounts originally proposed or in the <br />alternative set limits higher than,that originally proposed. <br />Commissioner Wodtke inquired if both companies were <br />notified of this recommendation, and Attorney Brandenburg <br />stated that Attorney Jackson representing Rural Sanitation <br />was sent a copy of the memo, and he discussed this with the <br />attorney for Waste Management on the phone several days ago. <br />They had no problem with the recommendation. <br />ON MOTION by Commissioner Bird, SECONDED by <br />Commissioner Lyons, the Board unanimously agreed <br />to allow the garbage franchise provisions to take <br />effect automatically -and the insurance limits to <br />increase automatically to those originally pro- <br />posed by the Commission. <br />
