people, especially those new to Florida, do not understand <br />the drainage problems they create by blocking the swales. <br />Discussion followed on the possibility of using the <br />special Assessment Ordinance as a vehicle to work with this <br />situation. Public Works Director Davis explained that when <br />petitions are received under the Petition Paving Program, <br />the Engineering Department also designs drainage in that <br />area. At the current time there is a meeting scheduled <br />Friday in regard to three streets which are to be addressed <br />in this manner; at that meeting recommendations will be made <br />to the property owners as to drainage, and they will be <br />given an option re culverts. Mr. Davis informed the Board <br />that the City of Vero Beach not only designs the whole <br />thing, but they assess for everything, including culverts; <br />their cost per front foot for improvements are, accordingly, <br />much higher than ours. He continued that we do have <br />drainage crews, but they are working on a more or less <br />crisis basis rather than on an on-going program. <br />Chairman Scurlock emphasized that we should have an <br />on-going program of maintaining and improving rather than <br />just dealing with crises, and he believed we will have to <br />get more aggressive in trying to prevent these problems. <br />Considerable discussion ensued as to the need for a <br />stronger ordinance to allow for better enforcement and also <br />in regard to the legal aspects of the right-of-way problem <br />and what authority the County crew has to act. It was noted <br />that the property in the right-of-way does belong to the <br />County, and it is there for a specific purpose. <br />Attorney Brandenburg stated that the County has the <br />privilege of removing any improvements the property owner <br />places in the right-of-way.
